Code of Conduct
Version 1: November 30, 2018
Purpose of this Code of Conduct
This Code of Conduct aims to combat misinformation on the subject and clarify for authors interested in submitting papers to the MISES: Interdisciplinary Journal of Philosophy, Law and Economics. It addresses academic plagiarism, with the intent to avoid legal issues and future embarrassment by informing authors of the measures taken in cases of suspicion and reporting, explaining the possible formats of plagiarism, and adopting a responsible stance in the dissemination of knowledge in an ethical and innovative manner.
What is Academic Plagiarism?
Academic plagiarism refers to the partial or complete extraction of ideas, concepts, or parts of publications by another author without giving due credit or explicitly citing the source. According to legal frameworks, this constitutes a violation of copyright laws, where ignorance of the law does not exempt the violator. The articles, reviews, and theses submitted to the journal must authentically convey the author's analysis, with clear specification of all content from other sources and authors. According to ABEC (2012), "Plagiarism is the appropriation of ideas, processes, results, or words from another person without due credit."
Legal Implications of Plagiarism
Plagiarism is considered a crime under Brazilian law, as stipulated in the Copyright Law (Law 9.610/1998). It can lead to both criminal and civil penalties, as it violates the inalienable rights of the original author.
How to Avoid Plagiarism?
To avoid committing plagiarism, it is essential to use your own words when writing and provide proper citations for all external sources. Direct quotes should be clearly marked and attributed to the original author.
How the Journal Prevents, Investigates, and Punishes Cases of Plagiarism
The journal uses anti-plagiarism software to detect potential issues. However, if a manuscript is suspected of plagiarism, anyone can report it, initiating an investigation by the editorial board. The journal reserves the right to retract articles found to have violated ethical standards.
Final Considerations
Authors must ensure that all work submitted is their own and must provide evidence of authorship if requested. The journal stands firm in defending ethical and legal principles and will act transparently to maintain its credibility.
